These Terms of Service ("Terms") govern your access to and use of the Marilah POS website, software, QR ordering, food-court solution and related services (collectively, the "Services"). By using the Services, you agree to these Terms.
1. Eligibility and accounts
You must be able to enter into a legally binding agreement and provide accurate, complete and current information. You are responsible for safeguarding your account credentials and for activity under your account. Notify us immediately if you suspect unauthorised use.
2. Using the Services
We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Services in accordance with these Terms and your service plan. You must not misuse the Services, interfere with their operation, attempt unauthorised access, upload unlawful or infringing content, or use them in breach of applicable law.
3. Your data and responsibilities
You retain rights in data you enter into the Services and are responsible for its accuracy, legality and obtaining any required consents. You are responsible for restaurant operations, menus, pricing, taxes, staff management, customer communications and compliance with local laws and payment requirements.
4. Fees and payment
If you use paid Services, applicable fees, billing cycle, taxes and refund arrangements will be stated in your order, quotation or separate written agreement. Unless otherwise agreed, fees are non-refundable. We may suspend or limit the Services for overdue payment to the extent permitted by law.
5. Intellectual property
The Services, including their software, design, trademarks and content, are owned by Marilah or its licensors and protected by intellectual property laws. No rights are granted except as expressly set out in these Terms.
6. Availability and changes
We make reasonable efforts to keep the Services available, but do not guarantee uninterrupted, error-free or universally suitable operation. We may modify, suspend or discontinue parts of the Services for maintenance, security, legal or product-improvement reasons and will give notice where reasonably practicable.
7. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available”, without express or implied warranties. Marilah is not liable for indirect, incidental, special, consequential or punitive losses, or for loss of profits, data, goodwill or business opportunity. Any liability that cannot be excluded is limited to the maximum extent allowed by law.
8. Termination
We may suspend or terminate access if you breach these Terms, fail to pay amounts due, or where reasonably necessary to comply with law or protect the security of the Services. Provisions that by their nature should survive termination will survive.
9. Changes and contact
We may update these Terms; continued use after an update means you accept the updated Terms. For questions, contact Marilah Support on WhatsApp.
